Neither party will recover its attorney fees and costs in arbitration. You may choose to have the arbitration conducted by telephone, written submission, or in person, either in the county where You live, or in Los Angeles County, California, as you choose.

We each agree that We waive any right to a jury trial, and that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action, and that You will not act as a plaintiff or class member in any purported class or representative proceeding or act as a private attorney general. We also both agree that You or We may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

The parties agree to submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. If any term or provision of this Section is invalid, illegal, or unenforceable to any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Section or invalidate or render unenforceable such term of provision in any other jurisdiction. The parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of Your agreement to participate in any of our Programs.
